WHY IS THIS
COURSE IMPORTANT?
The American Recovery & Reinvestment
Act imposes deadlines
for use of special Economic Stimulus Funding and
requires that projects funded under ARRA must be
ready to start and be completed expeditiously.
In addition, the current Federal Highway
Authorization, Public Law 109-59 - Safe,
Accountable, Flexible, Transportation Efficiency
Act - A Legacy for Users (SAFETEA-LU) expires in
September 2009. It is important that Indian
tribes keep in mind the following critical
deadlines if they are to use their share of IRR
allocations:
- July 15, 2009 deadline to state tribal
"commitment" to use current and prior year
Highway Trust Funds (i.e. SAFETEA-LU funds). Current and prior year
Highway Trust Funds must be obligated into
contracts no later than September 30, 2009, or
they will be withdrawn and may be
permanently lost.
- August 15, 2009 deadline to state tribal
"commitment" to use special ARRA/IRR funds.
Funds must be obligated no later than February
17, 2010. A tribe's allocation of these funds
not obligated by September 30, 2010 will be
withdrawn and may be permanently lost.
- All remaining ARRA/IRR funds not obligated
into contracts by September 30, 2011 will be
withdrawn and may be permanently lost.
- All ARRA/IRR funds under a contract must be
fully expended no later than September 30, 2012
or the funds may be withdrawn and may be
permanently lost.
Tribes must act
quickly! To be eligible for funding, projects
must be "Shovel Ready". This means the proposed
project has met all the requirements for award
of a contract, including:
- Road and Bridge projects are prioritized and
are in the approved Tribal Transportation
Improvement Program (TTIP).
- Roads and Bridges are included in the
approved Indian Reservation Roads Transportation
Improvement Program (IRRTIP).
- Surveys and materials investigations are
completed.
- National Enviromental Policy Acy (NEPA)
clearances and permits are obtained.
- Project Specifications and Estimates
(PS&E's) are completed and certified by a
Professional Engineer.
