This course covers Federal Indian case law that formed the foundation for the Indian Self-Determination Act. It covers Congressional policy and the tenets of the Indian Self-Determination Act with a special focus on rights of Indian tribes under the law. This course covers the '638 contracting and self-governance compacting process under the Act. It includes a detailed instruction on the implementing regulations in Chapter 25 - Code of Federal Regulations, OMB Circulars, and Contract Support Costs. This course is an excellent overview of the provisions of the Indian Self-Determination Act and is intended for tribal leaders, program managers, and federal managers.

Construction Contracting under the Indian Self-Determination Act (3 Days) |

The 1988 Technical Amendments to the Indian Self-Determination Act provided for construction contracting and 25 CFR SubPart J was developed specifically to provide guidance for construction projects under the Act. This course provides information on basic rules under the Indian Self-Determination Act and provides procedures to be used in the various phases of construction contracting. This course identifies how '638 construction contracting is different from commercial construction contracting. This course also covers such programs as the new Indian Reservation Roads Program regulations at 25 CFR Part 170 and facilities construction. Construction Contracting under the Indian Self-Determination Act is intended for tribal construction project mangers and program directors and federal managers responsible for construction programs.

Contracting and compacting under the Indian Self-Determination Act requires tribes and tribal organizations to have management systems, including financial management systems. Tribes and tribal organizations must abide by OMB Circulars including Circular A-87 Cost Principles, and OMB Circular A-133 the Single Audit Act. This course covers financial management and budget issues including Contract Support Costs (indirect contract support, direct contract support costs, start-up costs), audits, the audit resolution process and the Federal appropriations law. The course includes an overview of the Indirect Cost Proposal preparation and negotiation processes. It also includes a discussion on using the Alternative Disputes Resolution process for addressing audit and funding issues. It also includes a discussions on the funding provisions of the Act; Indian Health Service's Contract Support Cost Policies and the Bureau of Indian Affairs' Contract Support Cost policies. Understanding Your Fiscal Responsibilities Under the Indian Self-Determination Act is intended for tribal '638 program directors and mangers; and federal managers that have oversight responsibility for contracted and compacted programs.

Course provides techniques for writing proposals for Indian tribes and tribal organizations. Learn how to link your projects to funding opportunities. A checklist is provided to prepare you for developing and writing grants for categorical and competitive grants. This course provides instruction on how to develop measurable goals, objectives, and action plans. Development of a meaningful and reasonable grant budget is key to obtaining grants. Techniques on surfing the Web for Notice of Funds Availability (NOFA), Requests for Applications (RFAs), Program Announcements and Requests for Proposals (RFPs), and other funding sources will be provided. A sample of potential funding sources for community development programs is provided. Tips on what grant evaluators look for is also offered to provide an inside track for successful grant writing. Bring your draft grant proposals to work on during the course. Grant Writing is intended for tribal leaders, board members and program managers; tribal planners, grant writers and grant management staff.

Unserstanding Your Roles and Responsibilities as Board Members (3 Days) |

Awarding Officials and Awarding Officials' Technical Representatives must have a basic understanding of federal contract law and must understand how contracting principles under the Indian Self-Determination Act are unique and different from regular commercial contracts. The course provides detailed instruction on the principles of the Indian Self-Determination Act and differentiates it from regular commercial contracting. It provides highlights of the statutes and provides detailed instruction on its implementing regulations at 25 CFR Part 900. It covers funding issues including contract support costs and direct funding; compliance issues; contract disputes processes, audits and audit resolution processes; model contracts and annual funding agreements. Most importantly, it identifies the roles and responsibilities of Awarding Officials and the Awarding Officers' Technical Representative. Federal Indian policy has developed through the evolution of federal case law and affects all Indian tribes, tribal organizations and the Indian people. United States Supreme Court decisions, including the Marshall decisions, shaped the federal-tribal relations to what is commonly referred to as government-to-government relationships. Tribal sovereignty and tribal rights are discussed in the course. Discussion will include recent developments in Indian law and how tribal sovereignty is challenged every day. This course is designed to provide tribal leaders and managers the basic, essential knowledge of the principles of Indian law and how this knowledge can be used in shaping tribal policy and their relationships with the federal government. Contracting Transportation Programs Under the Indian Self-Determination Act and the Safe, Accountable, Flexible, Efficient Transportation Equity Act - A Legacy for Users (SAFETEA-LU) (3 Days)

Public Law 109-59, commonly referred to as SAFETEA-LU provides special opportunities for Indian tribes to contract for transportation (Indian Reservation Roads) programs with the Department of the Interior - Bureau of Indian Affairs and the Federal Highway Administration's Federal Lands Highway Office. This course provides an analysis of Public Law 109-59, Safe, Accountable, Flexible, Efficient Transportation Equity Act - A Legacy for Users; and Public Law 93-638, the Indian Self-Determination & Education Assistance Act, and the implementing regulations in 25 CFR Part 900, 25 CFR Part 1000 and 25 CFR Part 170, with a special focus on construction contracting. It provides guidance on tribal rights under the law; and provides guidance on the policies and eligible uses of funds under SAFETEA-LU. It provides instruction on how Indian tribes can develop working relationships with local governments for Statewide Planning, Revenue Sharing Agreements and Road Maintenance Agreements.
