Tribal Transportation Programs: FAST Act

The Infrastructure Investment & Jobs Act (IIJA) will provide over $3.0 billion of one-time funding, over 5 years beginning FY 2022 through FY 2026, for such programs as the Tribal Transportation Programs (TTP) which includes the Bridge Investment Program, Safe Routes to Schools Program, Nationally Significant Federal Lands and Tribal Programs, Tribal High Priority Projects, Transportation Investment Program, BIA Roads Maintenance, and Tribal Transit Program.  The IIJA funding represents additional or supplemental funding to the annual appropriations (FAST Act) and creating tremendous opportunities for tribes to address their transportation infrastructure needs.  Tribes have the option to complete the projects through PL 93-638 - Subpart J construction contracts or compacts, through funding agreements with the Federal Highway Administration (Office of Tribal Transportation), or in the alternative, require the BIA or FHWA complete the projects through federal construction contract mechanisms.

The course will cover the Tribal Transportation Programs (TTP) funded by IIJA.  It will cover PL 93-638 statutes and regulations (25 CFR Part 900 and 25 CFR Part 170), and Federal Highway Administration programs that pertain to contracting of Tribal Transportation Programs (TTP).  It will include other TTP components such as the TTP funding formula, transportation planning, bridge, and safety programs. Special focus will be placed on 25 CFR Part 900; Subpart J – Construction of the Indian Self-Determination Act regulations. Subpart J prescribes rules concerning construction contracting covering the pre-planning phase, planning phase, design phase, and construction phase. See our course on PL 93-638 Construction Contracting: Subpart J.  The course will also cover the TTP regulations found at 25 CFR Part 170 that identify transportation projects that are eligible for funding under the FAST Act, the National Tribal Transportation Facility Inventory (NNTFI) Program and the TTP funding formula.
